The Consumer Product Safety Commission sued Baby Matters, LLC, after reports of five infant deaths while using their products. The complaint blames defects in the product's design, warnings and instruction that create a substantial risk of injury and death to infants.

Baby Matters, LLC is the make of Nap Nanny and Nap Nanny Chill, portable infant recliners designed for sleeping, resting and playing. According to the CPSC, 55,000 of the Nap Nanny, Generations One and Two were sold between 2009 and early 2012 and were discontinued. An additional 100,000 Chill models have been sold since January 2011. All models retailed for about $130 each.

The CPSC has received four reports of infants who died in the Nap Nanny Generation Two recliners and a fifth one who died in the Chill model. They have received more than 70 additional reports of children nearly falling out of the product.

A recall with Baby Matters, LLC was issued in July 2010 and the company announced an $80 coupon to Generation One owners toward the purchase of newer models. At the time, the CPSC was aware of one death related with the first generation recliner and 22 reports of injuries.

The CPSC decided to file a lawsuit after they said talks with the company failed to create an adequate voluntary recall. The lawsuit seeks an order requiring the company to notify the public of the defect and offer consumers a full refund.
